Terms of Use

These Terms of Use (the “Terms”) are an agreement between you and Yochum Software governing your access to and use of AppMettle™. By using AppMettle, you agree to these Terms.

1. Who may use AppMettle

You must be legally able to enter into these Terms. If you use AppMettle for a business or organization, you represent that you have authority to bind that organization.

2. Authorized use

You may submit only publicly available websites that you own or are authorized to scan. You may not use AppMettle to break the law, violate another person’s rights, access nonpublic systems, bypass security, distribute harmful code, interfere with the service, or place an unreasonable automated load on it.

3. What the service does

AppMettle performs automated checks of a public website and reachable public pages. A standard scan does not sign in, submit forms, make payments, perform a penetration test, or review source code. Features and scan coverage may change as the service improves.

4. Reports and your responsibilities

Reports are informational and may contain incomplete findings, missed issues, or false positives. You are responsible for reviewing findings, testing fixes, protecting report links, and deciding whether a site is ready to launch. Anyone with a report link may be able to view that report.

5. Repair Pack purchases

A Repair Pack is a one-time digital purchase for the report identified at checkout. It provides the repair material shown at purchase and one automated repair-verification re-scan for that report. Repair prompts are instructions for your builder or developer; purchasing a Repair Pack does not mean Yochum Software will edit your project, guarantee a repair, or provide source-code access. Prices and included features are shown before checkout. Except where required by law, completed digital purchases are nonrefundable after the repair material has been accessed or the included verification scan has been used.

6. Journey Tests

A Journey Test is a one-time digital purchase for one selected automated browser journey. You must own or be authorized to test the submitted app and must provide only temporary test credentials. A Journey Test may create a test account, trigger ordinary automated account email, and create test data. It will stop when it encounters CAPTCHA, multi-factor authentication, an inaccessible email step, missing permission, or another safety boundary. Checkout testing is limited to a clearly identified Stripe test-mode session; AppMettle does not authorize or intentionally submit live payments. You remain responsible for reviewing and removing test accounts and data.

7. Ownership

You retain ownership of the website and material you submit. Yochum Software owns AppMettle, including its software, design, branding, report format, and related intellectual property. These Terms do not give you ownership of AppMettle or permission to copy, resell, reverse engineer, or misuse the service or its branding.

8. Availability and changes

We may change, suspend, restrict, or discontinue any part of AppMettle. We do not promise that the service or any report will always be available, uninterrupted, error-free, or compatible with every website.

9. Disclaimer of warranties

To the maximum extent permitted by law, AppMettle is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not guarantee that a scan will find every defect, security issue, legal issue, accessibility issue, or launch risk, or that following a report will produce a particular result.

10. Limitation of liability

To the maximum extent permitted by law, Yochum Software and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, business interruption, or losses arising from reliance on a scan or report. Where liability cannot be excluded, our total liability arising from AppMettle will not exceed the amount you paid us for the service giving rise to the claim during the six months before the claim, or $25 if you paid nothing.

11. Indemnity

You agree to be responsible for claims and costs resulting from your unlawful use of AppMettle, your violation of these Terms, or your scanning of a site without authorization, to the extent permitted by law.

12. Ending access

We may restrict or end access if we reasonably believe you violated these Terms, created risk for AppMettle or others, or used the service unlawfully.

13. Governing law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except where applicable law requires otherwise.

14. Changes and contact

We may update these Terms as AppMettle changes. The effective date identifies the current version. Questions may be directed to Yochum Software through yochumsoftware.com.
